3. The Regulator's PAIA Guide
The Information Regulator has compiled a guide, in terms of section 10 of PAIA, on how to use the Act. Any person who wishes to exercise a right under PAIA may obtain it from the Regulator:

5. Records available in terms of other legislation
Certain records are accessible in terms of other laws, including:

- Basic Conditions of Employment Act, 75 of 1997
- Protection of Personal Information Act, 4 of 2013
6. How to request access to a record
- Complete Form 2 (Request for Access to Record of Private Body), available from the Regulator's website.
- Send the completed form to the Information Officer at the address in section 2.

State clearly:
- which record you want, in enough detail for us to identify it;
- the form of access you want (inspection, copy, transcript);
- your postal or email address, and a contact telephone number;
- the right you are seeking to exercise or protect, and why the record is required for that purpose. This is a legal requirement for requests to private bodies, and a request that does not explain it will be refused;
- if you are making the request on behalf of someone else, proof of your authority.
- Pay the applicable request fee (section 8).
We will decide on your request within 30 days of receiving it, and will notify you in writing. In limited circumstances this period may be extended by a further 30 days, in which case we will tell you why.
7. Grounds on which access may be refused
Access to a record must or may be refused on the grounds set out in Chapter 4 of Part 3 of PAIA. These include:
- protection of the privacy of a third party who is a natural person (s63);
- protection of the commercial information of the company or a third party (s64 and s68);
- protection of confidential information held about a third party (s65);
- protection of the safety of individuals and of property (s66);
- protection of records privileged from production in legal proceedings (s67);
- protection of research information (s69);
- where the request is manifestly frivolous or vexatious, or would involve a substantial and unreasonable diversion of resources (s45).
Access may nonetheless be granted where disclosure is in the public interest, as contemplated in section 70.
8. Fees
Two kinds of fee may apply, as prescribed by regulation under PAIA:
- a request fee, payable when you lodge the request; and
- an access fee, covering the cost of searching for, reproducing and preparing the record.
A requester who seeks access to a record containing their own personal information is not required to pay a request fee.
We apply the fees prescribed in the PAIA Regulations, as amended from time to time. The current prescribed fees are published by the Information Regulator, and we will confirm the amount payable in writing before proceeding.
9. Processing of personal information (POPIA)
PAIA manuals must now also describe how the body processes personal information.

A data subject may object to processing, or request correction or deletion of their personal information, using Form 1 or Form 2 prescribed under POPIA, sent to the Information Officer.
10. Remedies
There is no internal appeal procedure against a decision of the head of a private body.
If your request is refused, or we fail to respond within the prescribed period, you may:
- lodge a complaint with the Information Regulator using Form 5, within 180 days; or
- apply to a court for appropriate relief, in terms of section 78 of PAIA.
